1. Major (R) Huda of Bangladesh Army bought a land of 10 decimal at Sanarpar, Narayanganj in 2007 from his hard earned mission money of Sudan, Africa. Most of the time, ordinary citizens are not legally required to report a crime or to do anything to stop it. In other words, there is no general duty to be a 'Good Samaritan" but the exceptions are surprisingly widespread. Mandatory reporting requirements are frequently accompanied by provisions that make failing to file a report a crime itself. That failure is usually a misdemeanor but it can be a felony. Prosecutions for failure to report are very rare and usually involve strong evidence of a serious harm that could have been prevented if a person with a duty to make a report had done so.

4. Whether you choose to make a report or you are required to do so, do not make a false report. However, don’t confuse a false report with an honest mistake. If you tell the police the getaway car was red but the next day you remember it was white, that’s an honest mistake. While it’s alright to make an honest mistake in describing what you saw, you should not intentionally mislead the authorities. Providing a false report to the police is itself a crime. Similarly, if you are approached by law enforcement because you may have witnessed a crime and you choose to answer their questions, you should not lie. Making an intentionally false statement in response to a law enforcement question about an investigation is a crime often referred to as “misprision.”

5. Land grabbing of both rural and urban land by domestic actors is a big problem in Bangladesh. Wealthy and influential people have encroached on public lands with false documents and often with help of officials in land administration and management departments. It's open secret. They use local musclemen with guns and occupy local administrations, including the police. Most of the time, land owners feel obliged to sell their productive resources to the criminal actors at a price inferior to market value. The Land grabbing culture has been increasing day by day which is putting many people in a big crysis. Majpr (R) Huda is a poor victim of such an act.

7. The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act is an act which sets out to prevent arbitrary evictions. In terms of the Constitution of BD, "No one may be evicted from their Land/ home, or have their home demolished, without an order of court made after considering all the relevant circumstances. No legislation may permit arbitrary evictions.

8. So minimum time should be considered to find a solution in this sorts of cases like if the Deputy Commissioner of an area, on his own motion or on the complaint of or upon information received from anybody or a Local Authority, is satisfied after making such inquiry as he thinks fit, that a person is an unauthorized occupant, he may issue, in the prescribed manner, a notice directing such person to vacate the land, building or part thereof in his occupation within a period of thirty days from the date of service of the notice. So solution of this type of problem is easier and less time consuming if the authority possess the honest desire to solve peoples suffering.

9. On the other hand, critical land problems takes time and sometimes it becomes a never ending process, it seems. It also depends on the quality, capability and honest desire of the authority concern to get involved deeply to solve any kind of land problem within the shortest possible time possible.

10. Land grabbing is a serious crisis presently putting pressures on victim as well as the authority. Day by day it is increasing incrementally. It is now viewed and considered a serious crime against humanity but few land grabbers end up in jail. Instead, if you search for the news about law suits, court proceedings, convictions or imprisonment related to land deals, what you will largely find are reports of local communities being accused of wrongdoing. Yet the links between crime, corruption and those engaging in land grabbing deals are real. In this connection,

a. The illegal, harmful and unauthorized acts of such so called criminals of the society and the country, in broader terms. 

b. It is also to grow awareness among st all negative and criminal people to face obvious and rigorous punishments for committing such acts not to involve themselves in such heinous acts. 

c. It is also to ensure justice for poor and needy people through cutting crimes in the society. 

d. To ensure bringing crime to the forefronts of proper justice. It will also help in assisting the law enforcing agencies to clearly identify of few land grabbers who all are actively involved in all types of heinous criminal acts including land grabbing. They are making the life of the community/ society / country people miserable for their own illegal benefits thus increasing corruption and killing innocent peoples lives. 

Unfortunate Land Grabbing Incidents

12. Poor victim Major (R) Md. Lutful Huda, S/O - A N M Nurul Huda bought a land of 10 Decimal at Siddirganj, Khardaghoshpara, Rahim Market, Narayanganj, on 09/08/2007 from Mr. Suman Kazi and his mother of that area (Picture Attached). The land was surrounded with walls and a signboard was hoisting on the land bearing the landowner Major Huda's name and mob no since last 10 (ten) years.

13. Usually the criminal people involve themselves in such land grabbing incidents throughout the country. Here in this case, apparently it seems, following land grabbers are actively taking part in such dangerous activities as per the opinions of many people in that area. They are effectively involved in all sorts of land grabbing in that area for their personal illegal gain. Few Law Enforcing Agencies members are also a stakeholder of such punishable offence:

a. Major Huda bought the above mentioned land from Mr Suman Kazi's family (details are in attachment) who were the most desirous to sell the land to Mr Huda. Even after selling the land, he and his family along with other criminals working actively to get their illegal due share, which is otherwise the negative nature of them. Antisocial and harmful activities of themselves are well known in the area which can be surely confirm after accurate investigation. Just to note, Mr Suman Kazi's late father was a simple 'Meter Reader' and came from a poor background but the wealth in terms of lands and other holds claimed and possessed by themselves raised thoughtful questions monster the general people in the area. It's a firm conviction that proper investigation by 'Law Enforcing Agencies' and 'Durniti Daman Department' of Bangladesh Govt can surely identify and confirm many of their misdeeds to commensurate with their illegal earning and possession of vast area of land. Further and detail information regarding them and their negative acts are enumerated in the attachments with this write up. 

b. On the contrary, MAJOR (R) Mr Huda is well known as a sober, positive human being with deliberately kind attitude and pious man. He also attained better name and fame in Bangladesh Army and also in civil arena for possessing helping and caring attitude and gesture throughout the places. Moreover he can be termed as 'possessing best values, honesty and integrity in all aspects of his life. Referrence in this regard may be considered and taken from Bangladesh Army, spl from Chief of Army Staff and others and from Police specialy the then IG Noor Muhammad and Addl IG Naba Bikram Kishore Tripura. 

c. He bought the land from the hard earned money from a deadly mission he served in Sudan, Africa and was awarded with 'Force Commanders Commendation' for the valuable service he rendered. He bought the land on 17/ 12/ 2007 through proper registry in court. The land was completely out of any discrepencies, anamolies and problems which can be terned as 'crystal clear'.. A signboard were hoisting bearing details of the new landowner Mr Huda. He also Developed the land and build boundary walls surrounding his land.

d. The influential and powerful but criminal land grabbers of that area inevitably, directly and indirectly forcing Mr Huda to leave the land and place if he desires to save his life and his family that has put tremendous physical and mental pressure on them that may also turn into termination of their survival.

e. Another well known so called renowned landgrabbers who is the owner of Rahim Market, Mr Rahim is also playing a vital role to put innumerable pressure on Mr Huda to vacate his land. Eviction of such category are many in the area will surely be confirmed in further study and proper investigation. Besides various antosocial activities, he committed a serious crime of encroaching and grabbing this same land in 2008. In this connection, he broke and destroy the boundary wall of this land and illegally occupied the land. Mr Huda then took help of police and other law enforcing agencies. He then contacted the land owner Mr Huda and begged apology many times over phone with an acknowledgement to repair the boundary wall. He begged apology saying holding legs time and again which everyone incluiding himself and the law enforcing agencies are aware. In this regard, related received copies of Siddirganj thana of that incident is enumerated with the attached with this letter. Details and further elaboration of his such and same nature various land grabbing acts will be furnished for further investigation.Both the activies of Mr Rahim of occupying and releasing the land during that time surely confirms of his daring land grabbing acts in that area.

f. Another person Mr Nazu, who was named and listed as "Bangladesh Top Criminals" earlier, now acting as he got changed his negative acts. But like the saying " Black Will Take No Other Hue" he also showed and expressed his negative remarks. He also seems to be involved in aggravating and adding adding disputes in this land. His detail all types of anto social activities will be furnished whenever needed, for the assisstance of further investigation on the dispute of the same land. 

g. Another Criminal named '"Lengra" and few other listed criminals are involved in destroying the boundary wall of the land with an ill intension of grabbing the land illegally as per different sources. Name and mobile number are hoisted on the sign board. 

Top Big Questions 

9. The land purchased on 2007. No one claimed this land before and after the purchase of this land from 2007 till 2018 except one serious crime of destroying the boundary wall in 2008 by Mr Rahim and Gong. (Related paper attached). The Big Top Question is " Why the 'Grouped Criminals' stated above has become active now again after 11 years of purchasing the land? Where were they and their claim for last approx 11 years. Why again few days back, they have committed same sorts of serious crime of encroaching this land. Many people opined that they are most likely playing a disastrous and heinous act to dis stabilize present Govt.

10. It may be noted that the criminals stated above are spreading the news with an evil intention that "the father and in law of the land owner Major Huda are Awami League Leader. Huda's uncle in law was also 'Gen Secy' Of Jagannath Versity Chatra League (Mr Shapan) and spreading rumour to further proof of their thiefish and anto Govt act. 


11. Bangladesh Govt may also check the facts of the above all statements enumerated and also try to find their ill motive, anti social acts and also anti Govt acts and further ill motive, is any.

Eviction of Unauthorized Occupant

12. Law of the Land of Bangladesh Land Ministry has specified the solutions of such problems are as follows:

  5. (1) - If the Deputy Commissioner, on his own motion or on the complaint of or upon information received from anybody or a Local Authority, is satisfied after making such inquiry as he thinks fit, that a person is an unauthorized occupant, he may issue, in the prescribed manner, a notice directing such person to vacate the land, building or part thereof in his occupation within a period of thirty days from the date of service of the notice 5[ :

THE GOVERNMENT AND LOCAL AUTHORITY LANDS AND BUILDINGS (RECOVERY OF POSSESSION) ORDINANCE, 1970 

(EAST PAKISTAN ORDINANCE XXIV OF 1970).

13. Provided that the Deputy Commissioner may, where he is satisfied that thirty days' notice will not be in public interest, reduce the period of such notice to not less than seven days.

  5. (2) If the person, against whom an order under sub-section (1) has been made, refuses or fails to vacate the land, building or part thereof in his occupation within the time fixed, then, notwithstanding anything contained in any other law for the time being in force, it shall be lawful for the Deputy Commissioner to enter upon such land, building or part thereof and recover khas possession of the same by evicting such person and by demolishing and removing structures, if any, erected or built by that person.

Concluding Remarks

14. The good news is that in some cases the crimes are being stopped. The bad news is that this further confirms the overall trend of corrupt business people and negative minded politicians using land deals to enrich themselves illegally. 

15. Most of the Bangladeshis are predominantly dependent on land for their daily living. Proper management of land can protect the interests of the bonafide cultivators and make their lives happier and healthier. To this end in view, the importance of reshuffling and introducing reform in the land management and land administration by making amendment to the existing laws or enacting laws where necessary cannot be exaggerated.

16. No policies or laws are going to change the life of the landless poor until the government is willing to implement those. If illegally occupied khas lands can be recovered and distributed among the landless poor then the damaging trend of rural-urban migration will be diminished. Poverty and many odds of the society can be reduced. If we can’t form and implement proper strategies regarding poor and landless, then poverty will continue to exist in Bangladesh.
